spouse can never be dependent.
it mitlucky's husband can file as resident, he can
file jointly with her and she can still claim the
treaty benefit, as I understand.

: There are 5 tests in 1040 instruction for a person to be claimed to be a
: dependent of another. Income test requires the person's gross income be less
: than $2900.
: If you cannot pass this test, my opinion is that you two can file jointly
: and you still can claim the $5000 treaty. See shishishishi's post. He did a
: good job on explaining this.

: : Hello,
: : I am a dependant F1 of my husband, who has H1 visa. He is filing tax form for
: : both of us.
: : I have F1 visa and I am a student worker at my univ. Since there is a
: : sino-america treaty of $5,000, I recieved 1042-s for this $5000 from school.
: : Now my husband is filing tax return form and included me as his dependant. My
: : question is: does he has to pay tax for my first $5000? In other words, can I
: : still enjoy sino-america treaty?
: : Looking forward to your answer soon.
: : thank you very much
